Terms of Service
These terms cover your use of the Thermo app and this website. Plain language, no surprises — but please read them, because installing or using Thermo means you agree to them.

1. Who we are
Thermo ("Thermo," "we," "us") is an independent iOS app built by Jon Marus that lets you control a Daikin One+ thermostat. By downloading, installing, or using Thermo, or by using this website, you agree to these Terms of Service. If you don't agree, please don't use Thermo.
2. What Thermo does
Thermo connects to your Daikin One+ thermostat through Daikin's official integration, using a token you generate yourself. It is a third-party app — it is not made by, affiliated with, endorsed by, or supported by Daikin. "Daikin" and "Daikin One+" are trademarks of their respective owners, used here only to describe compatibility.
To use Thermo you need your own Daikin One+ thermostat and a Daikin account in good standing. Your thermostat and account are governed by Daikin's own terms and privacy policy, which are between you and Daikin.
3. Your license
We grant you a personal, non-exclusive, non-transferable, revocable license to use Thermo on Apple devices you own or control, for your own non-commercial use, in accordance with the Apple App Store terms. Thermo is licensed, not sold to you. You may not copy, modify, reverse-engineer, resell, or redistribute the app except as permitted by law.
4. Purchases
Thermo Pro is a one-time purchase that unlocks additional features. Purchases are processed by Apple through the App Store and are subject to Apple's terms. Pricing is shown in the app before you buy. Refunds are handled by Apple under their policies — we can't issue refunds directly. We may change features or pricing for future purchases, but a purchase you've already made won't be revoked.
5. Acceptable use
You agree not to:
- Use Thermo to break the law or infringe anyone's rights.
- Interfere with, overload, or attempt to gain unauthorized access to Thermo, Daikin's systems, or our infrastructure.
- Use Thermo with a Daikin account or thermostat you aren't authorized to control.
6. Third-party services
Thermo depends on services we don't control — primarily Daikin's cloud and Apple. If Daikin changes, limits, or discontinues its integration, or if your Daikin account or thermostat stops working, Thermo's features may be affected and we may not be able to fix it. We're not responsible for outages, changes, or actions of these third parties.
7. No warranty
Thermo is provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement, to the fullest extent permitted by law. Thermo is a convenience for adjusting your thermostat — it is not a safety, security, or life-critical system. Don't rely on it to prevent freezing, overheating, equipment damage, or any other harm. Always keep your Daikin thermostat and any safety controls functional and independently accessible.
8. Limitation of liability
To the fullest extent permitted by law, Jon Marus will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of (or inability to use) Thermo — including damage to your HVAC equipment, property, or comfort. Where liability cannot be excluded, our total liability to you is limited to the amount you paid for Thermo in the twelve months before the claim, or CAD $20, whichever is greater.
9. Changes and termination
We may update Thermo, these terms, or discontinue the app at any time. If we make material changes to these terms, we'll update the effective date above and note it in the app or on this site. Continuing to use Thermo after a change means you accept the new terms. You may stop using Thermo and delete it at any time.
10. Governing law
These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts located in British Columbia, Canada, except where your local consumer-protection laws give you the right to bring a claim elsewhere.
11. Apple
This agreement is between you and Jon Marus, not with Apple, and Apple is not responsible for Thermo or its content. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Your use of Thermo must also comply with the Apple Media Services Terms and the standard Licensed Application End User License Agreement.
